This website is owned and operated by AJ and Sandra Brandt, as unDESERTED. The website offers visitors:

unDESERTED’s Obligations

1. Subject to users complying with and discharging each of its obligations under these Terms, unDESERTED will allow users access to, and use of, the website and services.

2. unDESERTED may collect users’ personal data during the use of the website and service (the user hereby consents irrevocably and unconditionally to said collection), and will comply with use and disclosure of such data in accordance with the website Privacy Policy (also accessible through the link on the website). Note: unDESERTED will only disclose user information to relevant third-party service providers and online partners as set out in the Privacy Policy.

 

User Community obligations/Subscription requirements

• Please be aware that, if you create a member subscription profile as part of the User Community, all users that join the community have a profile that is visible to other members.

• Only users who are 18 years or older, or who are of the legal age of majority in their jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement, are allowed to create a subscription account.

• Any user can opt-out and exit the community, and upon doing so, such user’s profile will not be visible. Naturally, in such event the user will no longer be able to use the community features (e.g. liking, commenting or writing posts).

• User will create a password and account upon completing the website subscription process. Users are responsible for maintaining the confidentiality of their password and account, and are fully responsible for all activities that occur under their password or account. They agree to (a) immediately notify unDESERTED of any unauthorised use of passwords or account, or any other breach of security, and (b) to ensure that they exit from their account at the end of each session.

• unDESERTED cannot and will not be liable for any loss or damage arising from failure to comply with this obligation.

 

Modification of the website

unDESERTED reserves the right to modify the organisation, structure, content or “look and feel” of the website and/or services, and may change, suspend, or discontinue any aspect of the website and/or service at any time without notice or any liability to user or any person. unDESERTED shall have complete discretion over the features, functions and other terms and conditions on which the website and service is made available.

 

Intellectual Property Rights

User acknowledges that these Terms do not convey, and that they derive no right, title, or interest in, or to, any Intellectual Property Rights that vest or subsist in, or relate to, the website and/or services other than to being granted a limited revocable licence to access and use the website and the service for its intended purposes, subject to users’ compliance with these Terms. This licence does not include the right to collect or use information contained on the website for purposes prohibited by unDESERTED; to compete with, create derivative works based on the layout/design/look-and-feel/ structure of the website, or download/copy the website (other than page caching). If user uses the website in a manner that exceeds the scope of this licence or if it breaches these Terms, unDESERTED may revoke the licence and deny access to and use of the website.

 

Information and Promotional content

You agree to receive, from time to time, promotional messages from us, by email or social media messaging. If you don't want to receive such content, please notify us on ajsmundeserted@gmail.com at any time and we will cease sending out these messages to the address(es) you provide.

 

USER ACKNOWLEDGES AND AGREES THAT unDESERTED CAN, IN ITS SOLE AND UNFETTERED DISCRETION, UNILATERALLY AND WITHOUT NOTICE, TERMINATE THESE TERMS OF USE, DISABLE AND DENY ACCESS TO THE USER TO THE WEBSITE AND ITS SERVICES, AND TAKE LEGAL ACTION AGAINST ANY USER WHO ENGAGES IN ANY ACTIVITY OR CONDUCT THAT IS PROHIBITED BY THESE TERMS OF USE AND/OR BY ANY RELEVANT LAW, REGULATION OR RULE.
